Dear fellow e-smokers,
This past Thursday, something amazing happened. Something that affects every e-smoker worldwide.
United States District Court Judge Richard Leon issued a preliminary ruling in the case of Smoking Everywhere & Njoy vs. FDA. He ruled emphatically in favor of e-smokers everywhere. Although this ruling was a preliminary one, this is the first step towards our industry being safely regulated.
So why is this so important? Haven’t you always been able to get most e-cigs and supplies whenever you wanted them? Sure. However, if not for this ruling, all that may have changed, and pretty soon too. Had Judge Leon ruled that electronic cigarettes fall under the FDA’s purview as drug device combinations, the FDA would have been able to essentially “ban” all e-cigarettes by requiring companies to file for drug approval; a process that could take several years and cost hundreds of millions of dollars. In essence, putting the electronic cigarette industry out of business, and taking away your choice to use a recreational product that we’ve all grown to love.
So what’s going to change? A lot. Now that financiers, investors, manufacturers, and retailers know that electronic cigarettes have a future, and that their popularity is growing by exponential proportions, you can expect to see a far greater choice in e-cigarette hardware, accessories, and Smoke Juice. And the quality of the hardware is now likely to increase at a similar rate as the growth of the industry as a whole.
As America’s first Smoke Juice maker, Johnson Creek looks forward to continuing to lead the industry to a level of safety, purity, innovation and choice such as it has never seen before. I guess you could say this ruling marks the next stage in the evolution of e-smoking. So let’s get ready together. Let’s get excited about something we all love doing. Let’s get ready for E-Smoking 2.0.

I think Judge Leon made a very fair and responsible decision. He focused on the law and the authority granted the FDA and rightfully decided that they don’t have authority over e-cigarettes since they don’t contain tobacco, which is what the FDA DOES have regulation over. I’m not against regulation, I just think any regulation should be fair and not abusive.
And you’re right, a lot will start to change now! Good article, thanks for sharing!
I switched to E-cigs 12/17/2009 and have been smoking Johnson Creek the whole time expect for a few tips that came with my Zigcigs from Zigcigs.com . I feel so good now and was so impressed with the product’s of both companies. I had to start a website to help other feel good also. This ruling is going to help so many people give up the harmful tobacco and get on the Juice. Thank you Johnson’s creek for providing such a good product. My favorite is Tennessee Cured. I got you sample pack when i started. i mixed four of the flavor’s and came up with fruit punch it’s awesome.
The people on my shift all four of us have changed to e-smoking. And we all Smoke JC E-juices.

It may have been a preliminary injunction ruling, but I think it speaks loudly about FDA not having regulation authority over e cigarettes in the future. There is still a long way to go, but this was a first step in the right direction.
